General Terms and Conditions of the Maren Jewellery Online Store
1. Contracting party and applicability of the General Terms and Conditions

83254 Breitbrunn am Chiemsee, Tel.: +49-178-1890685, Email: info@marenjewellery.com. Maren Jewellery operates the Maren Jewellery online shop at marenjewellery.com. These General Terms and Conditions apply exclusively to all purchases made in the Maren Jewellery Online Store.

3. Conclusion of contract
The offers in the Maren Jewellery Online Store constitute a non-binding invitation to order items. By ordering the items by clicking the "Buy now" button, the customer submits a binding offer to purchase the items contained in the shopping cart. Maren Jewellery will inform the customer without delay by email that the order has been received and will also confirm the conclusion of the contract in the same email.

5. Delivery times
The delivery time within Germany is 1-3 weeks depending on the piece of jewellery; for deliveries within the European Union, Switzerland, Norway and the United Kingdom four weeks, and for deliveries to other countries five weeks from conclusion of the contract.
6. Delivery and shipping costs
All items in one order are shipped together.
We ship all our jewellery pieces insured with UPS, Fedex or DHL Express. Shipping is free and always insured via express delivery.
Any customs duties are the responsibility of the customer.
If the goods cannot be delivered for reasons for which the customer is responsible (e.g. due to an incorrect delivery address), the customer shall bear any delivery costs incurred for redelivery.
7. Prices and invoice
The prices in the Maren Jewellery Online Store are in euros and include the applicable statutory VAT. The invoice will be sent to you by email at the time the goods are shipped.

8.1 Paypal
If you have chosen PayPal as your payment method, you must be registered there in order to pay the invoice amount, or you must first register and authenticate yourself with your access data. The payment transaction is carried out automatically by PayPal immediately after confirmation of the payment instruction. If the identity and credit check is positive, you also have the option of paying the purchase price using PayPal 0% financing. This is an instalment payment model offered by PayPal under which you can pay the purchase price in monthly instalments without interest charges (0% APR).
8.2 Credit card
If you have chosen credit card as your payment method, your payment details will be requested directly as part of your order. The payment transaction is carried out automatically by the relevant payment service provider immediately after confirmation of the payment instruction.
8.3 Purchase on account
If you have chosen purchase on account as your payment method, payment becomes due upon our payment request in the contract confirmation email and must be settled by you within 10 (ten) days of receiving this email. We will inform you without delay by email once payment has been received. If payment is not made within the 10-day period, we are entitled to withdraw from the sale. In this case, we will inform you of the withdrawal and refund any payments received too late.
8.5 Bank transfer
If you have chosen bank transfer as your payment method, your bank details will be requested during the payment process. The payment transaction is carried out by your bank after confirmation of the payment instruction.
9. Retention of title
The delivered goods remain our property until full payment has been made.
10. Right of withdrawal

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

by means of a clear declaration (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. You may use the attached withdrawal form for this purpose, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
You can also exercise your right of withdrawal online at Cancel order. If you use this online function, we will promptly send you a confirmation of receipt on a durable medium (e.g. by email) containing information on the content of the withdrawal declaration as well as the date and time of its receipt.
Consequences of withdrawal
If you withdraw from the contract, we shall reimburse to you all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or until you have supplied evidence that you have returned the goods, whichever is earlier.
You must send back or hand over the goods to Maren Jewellery, owner Helge Hautpmann, Rimstinger Str. 28B, 83254 Breitbrunn am Chiemsee without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
You only have to pay for any loss in value of the goods if this loss in value is due to handling by you that was not necessary for checking the condition, properties and functioning of the goods.

11. Exclusion of the right of withdrawal
11.1 The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.
11.2 Cases under section 11.(1) include, for example, jewellery pieces with engravings or custom-made jewellery pieces, as these jewellery pieces are intended for final sale and were individually made according to the customer's instructions.
12. Exercising the right of withdrawal
In the event that you exercise your right of withdrawal, please request the return label from info@marenjewellery.com for easy processing and insurance of the goods.
13. Defects
The statutory warranty rights for defects apply to goods from Maren Jewellery.
14. Liability
Where liability without fault is required by law (e.g. under a guarantee or the Product Liability Act), Maren Jewellery shall be liable without limitation, as well as in the case of personal injury (injury to life, body or health). Maren Jewellery is also liable without limitation for intent and gross negligence. In cases of slight negligence, Maren Jewellery shall only be liable for the breach of cardinal obligations. Cardinal obligations are obligations whose fulfilment is essential for the proper execution of the contract and on whose compliance you may regularly rely. In these cases, however, Maren Jewellery shall not be liable for indirect or unforeseeable damage, consequential damage resulting from defects, lost profits or lost savings. In all other respects, Maren Jewellery's liability for slight negligence is excluded. This limitation of liability also applies to the legal representatives, employees, staff members and vicarious agents of Maren Jewellery.
15. Contract text
Maren Jewellery does not store the contract text for you, and after the conclusion of the contract it is no longer accessible to you on the Maren Jewellery website. However, when concluding the contract, you have the option of accessing and saving the contractual provisions, including these General Terms and Conditions.
16. Complaints
Maren Jewellery is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board in accordance with the Consumer Dispute Resolution Act (VSGB). You can reach us by email at info@marenjewellery.com.
17. Final provisions
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. This does not affect provisions that cannot be derogated from by agreement under the law of the country in which the customer has their habitual residence.
